Deposition
Policies for all depositions
- Upon request for a deposition, it is the responsibility of the attorneys (client and/or noticing attorney) to communicate which party will pay the invoice for the deposition.
- Advance notice of a video-recorded deposition is required. If advance notice is not provided, we reserve the right to postpone the deposition upon arrival.
- Depositions scheduled less than 10 business days in advance may be subject to rush work fees.
- If a case settles before a previously scheduled deposition and we are not made aware of the settlement, clients will be charged for any time spent preparing for the deposition.
- Advance notice and written confirmation of a de bene esse (i.e., for trial) deposition is required, even if it occurs the same day as a discovery deposition.
Policies for in-person depositions
- Perceptio Forensics does not have office space available for depositions. Therefore, attorneys (client and/or noticing attorney) are responsible for locating a meeting space for an in-person deposition.
- Portal to portal travel expenses (airfare, time in transit, mileage reimbursement, hotel, meals, etc.) will be incurred and are the responsibility of the party paying for the deposition.
- A written agreement must be signed by the party responsible for payment of travel expenses upon receipt of the notice of deposition.
- We reserve the right to request prepayment for expenses associated with the deposition, including expected travel costs.
